Basic Operation Policy   1. Project Elan is a game ("game") developed Freetive® and serviced by PLAYnetEarth. ("Company" or "We" or "Us"). We operate the game according to this Operation Policy. The Operation Policy is the standard for the provision of smooth service and protection by our customer service to the game users and also to swiftly and consistently handle problems arising in the game. 2. We have the right to amend, delete and add the contents of this Operation Policy to minimize game user's inconvenience and to provide stable service. We will notify you about such changes through the homepage or in the game. We are not responsible for the problems incurred if the game user did not fully understand the Operation Policy. 3. Matters not mentioned in the Operation Policy will be dealt with by "PLAYnetEarth Terms of Service", "Privacy Policy", The Act on Promotion of Information & Communication Network Utilization and Information Protection, etc and other related rules and regulations. Rights and Duties of Game Users   1. Game user should not conduct any behavior violating our Terms of Service, Policy or social convention. If he/she gets into trouble by conducting such behavior, he/she will not able to obtain our help. 2. Users should provide truthful entries upon registration. If a user steals and uses somebody else's personal information, he/she will not able to get any protection from us. 3. Users may ask questions and seek solutions when faced with unsolvable problems while playing games by emailing us or by calling our customer service centre. Contact details are as follows. Users should not conduct any behavior disturbing another user's game play or smooth game operation, etc, and render maximum assistance to Game Master("GM")'s consultation and request. Users should notify to GM in the occurrence of a bug. If a user fails to notify the GM, and makes ill use of the bug or spread it to other users, he/she may be disadvantaged in the game. 5. In a case when a user is treated unfairly by GM or is hampered by problems arising in the game, he/she may make inquiries or demand correction through official channels. Roles and Activities of GM in the Game   GM works on the activities listed below and he does his best to ensure smooth game operation to the users' satisfaction. 1. GM observes our Privacy Policy and he does not inquire about game user's personal information (Account ID, Password, etc). 2. GM accepts matters related to all the bugs existing in the game, and he/she is duty bound to confirm it and ask for corrections. 3. GM does not act in favor of any specific user in the game. Neither does he/she provide information to game users regarding any updates other than matters that are publicized. 4. GM is not involved in a game user's activities in the game. However, if he/she deems that a user is disturbing smooth game operation by using harmful program or by interrupting other user's game, etc, he/she may give a warning for such behavior or block the account ID concerned. If the Company deems any user's behavior as seriously hindering game operation (examples: wreaking havoc on game order, violating public order and customs, etc), GM may mediate or impose sanction on the basis of this Operation Policy or general game norm shared among users. 5. If a specific NPC acts abnormally or disrupts game operation, GM has the power to eliminate or suspend its function by his/her own discretion. In the meantime if a game user does not report to GM even though he/she has discovered such NPC, but to make ill use of it, he/she may have sanctions imposed on them. 6. GM does not intervene in the disputes among users. However, if the dispute is deemed as a serious matter that is related to game operation (examples: wreaking havoc on game order, violating common law, public order and customs, etc), GM may mediate or impose sanction on the basis of this Operation Policy or general game norm shared among users. 7. In other situations not mentioned above, yet deemed to be in need of intervention for smooth game operation, GM may take appropriate measures on the basis of general game norm shared among users. Policy regarding Character Names   1. Users may name characters at their liberty. However, GM may change or delete character names which fall under categories listed below without prior warning. A name impersonating an official GM or deemed to have the intention of such impersonation. A name which is suggestive, lewd or slanderous. A name that induces revolt in others. A name implying the intention to make cash transactions, exchange between servers or make transaction with other games of items, characters or cyber money. A name belittling a specific religion, race or company, etc. A name impersonating the Company (or Development Team) or deemed to be made for the purpose of it. A name advertising a specific object. Other names hardly acceptable by social norm. Precautions for Game Play   1. Disputes among Users 1) GM does not intervene in disputes among game users. 2) If a user misunderstands the above provision and attempts to destroy the order in game through the measures listed below, GM may mediate or partly intervene. To give false report against or slander other users. To impersonate GM or to attempt to do so. To slander any specific nationality, race, religion, etc. To steal and use another person's account. To make ill use of bugs in the game, or to bring about trouble in game service. To use macro or any programs not approved by the Company. To publish or promote any homepages or links which include any programs or files not approved by the Company. 3) In line with 5.1.2, GM should strive to maintain neutrality and fairness. However, if a user does not follow the suggested solution without justification, GM may impose sanction against the user. 2. Limitation of Use GM may take appropriate measures on the basis of general game norm shared among users in cases where a game user conducts any of following behavior, or any behavior disturbing smooth game operation and other user's game, even if not specified below. 1) Foul-mannered behavior and behavior disrupting game order. Behaviors like disturbing another user's game play or inducing revolt in others in game, game message board, and homepage message board. The user may be subject to sanction for committing such an offence. Listed below are examples of such behavior. Revolting other users by: Disparaging the physical appearance of others, groundless slandering of others (guild). Sexually suggestive expressions or behaviors, or inducing sexual humiliation from others. Stalking, etc. To disturb smooth game operation and other user's game by: Intentional interruption of game events. Fostering antagonism among servers or communities or condemning whole community members. Publishing commercial postings on the message board. Multiple posting. To disturb GM's activities, attempt cash transaction and leak other people's personal information by: Spreading rumors which are not notified officially by Project Elan operation team. Groundlessly criticizing GM and the Company. Intentionally disturbing GM's activities. Attempting cash transaction or corresponding behavior. Trading game items or ID, etc for obtaining cash, attempting such trade or corresponding behavior. Leaking of the personal information of others (name, address, occupation, telephone no., and IP, etc) in the game or on the message board. Such behaviors are subject to criminal prosecution. 2) System (Bug) Abuse When a user discovers a bug in the game or system problem, yet he/she does not report it through official channels (email, phone to customer service centre), but instead spread it to others or makes ill use of it, he/she may be subject to sanctions. Listed below are examples of such behavior. To profit by using item or skill discovered to be abnormal. To profit by using monster's AI abnormality. To profit or destruct game balance by using bugs in the game. To spread bugs to others. 3) Use of Illegal Program Use of Illegal Program means: To affect game by using programs not provided by the Company. Examples: speed hack, multi loader, macro program, hacking tools, etc. To use inappropriate additional programs which may hamper equity among users. If a user is discovered using such programs by GM, he/she may be subject to sanctions, and if such use is confirmed he/she is to be imposed sanctions according to our Operation Policy. We particularly remind you that if a user suffers loss by using programs not provided by the Company, we are not responsible. 4) Provisions for Sanctions (Reference) Definitions of Sanctions Limitation of account use: Impossible to play for designated period. Permanent limitation of account use: Impossible to use game permanently. Limitation of character use: Impossible to use some characters owned by the account concerned for a designated period. Permanent limitation of character use: Permanently impossible to use some characters owned by the account concerned. Limitation of homepage use: Limited access to Project Elan. Game homepage is prepared to share any useful information related to the game and to make it more enjoyable. We hope game users' will use the message board as an arena of sound conversation. To achieve this goal, we observe our posting management principles specified below. 2. To promote healthy posting culture, GM may edit, move or delete postings that fall under the following list without prior notice. Postings violating public order or morals and customs. Similar advertisement or postings. Postings defaming or insulting others. Postings infringing other people's intellectual property right, such as copyright, etc. Postings instigating illegal copying or hacking. Postings published to disturb the Company's business or slander the Company. Postings violating Terms of Service and related law and regulations. Multiple / serial postings. Postings which may badly affect game operation. Postings impersonating game operators. Postings published for hacking / swindling. Postings intending any criminal act. Postings related to account trade / transfer. Postings related to cash transaction. Commercial postings. Other postings unrelated to the service of message board. 3. Provisions for Sanctions related to Homepage Message Board 1) Inappropriate Postings Item: sanctions 1st 2nd 3rd 4th To disturb other peoples' message board use by posting the exact same contents more than 3 times in a row : Limitation of homepage use for 7 days, Limitation of homepage use for 15 days, Limitation of homepage use for 30 days, Permanent limitation of account use To post contents containing curse: Limitation of homepage use for 7 days, Limitation of homepage use for 15 days, Limitation of homepage use for 30 days, Permanent limitation of account use To disturb normal service operation by cursing or by posting multiple messages on the message board for suggestions & bug report: Limitation of homepage use for 7 days, Limitation of homepage use for 15 days, Permanent limitation of account use To post lewd content: Limitation of homepage use for 15 days, Limitation of homepage use for 30 days, Permanent limitation of account use To post lewd images: Limitation of homepage use for 30 days, Permanent limitation of account use 2) Commercial Postings Item: sanctions 1st 2nd 3rd 4th To post contents soliciting cash transaction of game item or account: Limitation of homepage use for 15 days, Permanent limitation of account use To post contents soliciting trade of Project Elan's items/account with another game's items/account: Limitation of homepage use for 7 days, Limitation of homepage use for 30 days, Permanent limitation of account use To post commercial contents or to promote noxious sites to other users: Limitation of homepage use for 15 days, Limitation of homepage use for 30 days, Permanent limitation of account use 3) Postings related to Illegal Act Item: sanctions 1st 2nd 3rd 4th Leaking of other people's personal information (name, address, occupation, telephone no., and IP, etc) on the message board : Permanent limitation of account use To steal and use other person's account or to post hacking sites : Permanent limitation of account use Restoration Policy   If objective data is impossible to secure it is not restorable. Item loss owing to game user's deliberation or mistake is not restorable. Dormant Account Policy   A dormant account is an account which does not have connection record for a long period of time. We may suspend the service use of dormant accounts after a 1 week notification period through email or announcement. If this is the case, the entire information of account concerned is deleted. Personal Account Management   1. Individual game users are responsible for managing their personal information and account. Responsibility of account management lies with a game user. The Company is not responsible for any damages attributing to it. 2. Individual game users are responsible for the damage incurred by account sharing and transfer, cash and goods trade.
